Liability Waiver

Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement — Mid10 Athletics, Lafayette, Tennessee

1. Activities

This agreement covers all use of the Mid10 Athletics facility, including batting cages, pitching machines, private lessons, group workouts, strength and conditioning, and any other training, equipment or premises access ("Activities").

2. Assumption of Risk

I understand that baseball, softball and athletic training involve inherent risks, including being struck by batted or thrown balls, bats, or equipment; malfunction of pitching machines; slips, trips and falls; muscle strains, sprains, fractures, concussions, and other serious injury or, in rare cases, death. I knowingly and voluntarily assume all such risks, known and unknown, on behalf of myself and each participant explicitly named in the signed booking record.

3. Release and Waiver

To the fullest extent permitted by Tennessee law, I release, waive and discharge Mid10 Athletics, its owners, coaches, instructors, employees, volunteers and agents ("Released Parties") from any and all claims, demands and liability for injury, illness, death, or property loss arising out of or related to the Activities, including claims caused by the ordinary negligence of the Released Parties. This release does not apply to gross negligence or intentional misconduct.

4. Indemnity

I agree to indemnify and hold harmless the Released Parties from any claims, costs or expenses, including attorney fees, brought by or on behalf of the participant arising from the Activities.

5. Rules and Safety

Each named participant will follow all posted facility rules and staff instructions, wear a helmet in the batting cages, use equipment only as intended, and use the facility only during a reserved time. Access codes may not be shared. Parents must remain present at all times while their children are in the facility. Siblings sharing cage time must each be named in the booking record and covered by this parent-signed agreement. Mid10 Athletics may refuse or end access for unsafe conduct.

6. Medical Treatment

I confirm the participant is physically able to take part. In an emergency, I authorize Mid10 Athletics to obtain medical treatment for the participant, and I accept responsibility for any resulting costs.

7. Photos and Video

I consent to Mid10 Athletics recording photos or video during Activities for training and promotional purposes, unless I notify Mid10 Athletics in writing that I opt out.

8. Minors

For each named participant under 18, I represent that I am that child's parent or legal guardian. I sign this agreement for every child explicitly named in the signed booking record and on my own behalf. This signature does not cover unnamed children. I will remain present throughout my children's visits.

9. General

This agreement is governed by the laws of the State of Tennessee. If any part is found unenforceable, the remainder stays in full effect. This agreement remains valid for all future visits until revoked in writing. Electronic signature has the same effect as a handwritten signature.

By signing, I confirm I have read this agreement, understand that I am giving up substantial legal rights, and sign it voluntarily.
